Terms of use
The agreement between you and SME for using the website and its lessons.
Effective [Effective date]. SME is operated by SME-EDU LLC. These Terms of Use (“Terms”) apply to the website at https://sme-edu.com and the lessons, pictures, tools and plans offered there (the “Service”). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. Who may use the Service
Anyone may use the free parts of the Service. If you are under 18, use the Service with the permission of a parent or guardian, who accepts these Terms for you.
Plans may be bought only by an adult (18 or older) who can enter into a contract, such as a parent or guardian buying for a child. We never ask children for personal information.
2. What the Service is
SME is an independent study aid with math and science lessons from Kindergarten to college. It is not affiliated with, endorsed by or sponsored by any school, school district, college, university, testing organization or standards body. Course and skill names describe what is taught and do not refer to any particular institution's courses.
Lessons are for learning and practice. We work hard to make them correct, but they may contain mistakes and are not a substitute for a teacher, a textbook assigned by your school, or professional advice (for example engineering, medical, financial or legal advice). Check important results with your teacher or another source before relying on them.
3. Plans, payment and renewal
Some lessons need a paid plan. There is no sign-up fee. Plans and prices: Basic: $1 a month; Advanced: $5 a month; Premium: $10 a month or $100 a year. Prices are in US dollars; sales tax is added where it applies.
A plan is a subscription that renews automatically at the end of each period (a month, or a year for yearly billing) and is charged to the card used to buy it, until you cancel. Payments are processed by Stripe, Inc.; we do not see or store card numbers.
The Basic plan starts with a 7-day free trial. A card is needed to start it, and nothing is charged during the trial. Unless you cancel before the trial ends, the first month ($1) is charged to that card when it ends, and the plan then renews every month. The date the trial ends is shown before you start it, on the thank-you page and on the Plans page. One free trial per person or household; we may decline a trial that looks like a repeat.
A promo code from one of our promoters gives a new customer Premium free for 30 days instead of the usual trial. A card is needed to start it and nothing is charged during the free period. When it ends, the plan becomes Basic and $1 is charged that day and every month after, unless you cancel or choose another plan first (you can keep Premium, or choose any plan, at any time in Plans). We remind you on the site in the last week of the free period, and Stripe emails a reminder before the first charge. One promo code per person or household.
We may change prices for future periods. We will tell you on the Plans page and give at least 30 days before a new price applies to an existing plan; you can cancel before then.
Basic and Advanced plans hold a number of college courses you choose. You can add courses up to that number at any time; a course you have chosen can be swapped for another after your plan has renewed.
4. Cancelling and refunds
Cancel any time in Plans → Manage subscription, which opens Stripe’s billing page. Cancelling stops future charges; your plan stays open until the end of the period you have paid for.
Refunds are described on the Subscriptions and refunds page, which is part of these Terms. Nothing in these Terms limits a right to a refund that the law where you live gives you.
5. Restore codes
There are no accounts. When you buy a plan you receive a restore code that opens the plan in another browser or on another device. Keep it private: anyone with the code can use the plan. Sharing a code outside your household is not allowed. If you lose it, write to us from the email address used for payment and we will help you find it.
6. Your licence to use the Service
We give you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Service for your own learning, or, for teachers and parents, to teach with it (for example showing a lesson in class or at home). This licence ends if you break these Terms.
7. What you may not do
•
Copy, download in bulk, scrape, crawl or harvest the lessons, pictures, text, data or code, by hand or with automated tools, except as normal browsing allows.
•
Reproduce, republish, sell, rent, sublicense or distribute any part of the Service, or use it to build a competing product or to train machine-learning models.
•
Reverse engineer, decompile or disassemble the Service, or try to get around how plans unlock lessons.
•
Frame or mirror the Service on another site, or remove copyright, trademark or other notices.
•
Share restore codes publicly or sell them.
•
Interfere with the Service, overload it, or try to reach parts of it you are not meant to.
•
Use the Service in a way that breaks the law.
8. Ownership
The Service and everything in it, including the lessons, explanations, problems, pictures, illustrations, design, software and code, is owned by SME-EDU LLC and protected by copyright, trademark and other laws of the United States and other countries. “SME”, “Education For Everyone” and the SME logo are trademarks of SME-EDU LLC. Except for the licence in section 6, no rights are given to you. See the Copyright page for notices and how to report infringement.
9. Suggestions
If you send us ideas or suggestions, we may use them freely and without any obligation to you.
10. Services of others
Payments are handled by Stripe, and the website is hosted by Vercel. Their own terms and privacy policies apply to what they do. We are not responsible for services we do not control.
11. Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED OR THAT IT WILL IMPROVE ANY GRADE OR TEST RESULT.
12. Limit of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, SME-EDU LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS OR OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $10 IF YOU PAID NOTHING. SOME PLACES DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.
13. Indemnity
If you break these Terms or the law while using the Service, you agree to cover the reasonable costs and losses this causes SME-EDU LLC, including reasonable legal fees, to the extent the law allows.
14. Ending access
We may suspend or end access to the Service, or cancel a plan, if you break these Terms; if we cancel a plan for a reason that is not your fault, we will refund the unused part of the current period. We may change or stop parts of the Service; if we stop the Service entirely, we will refund the unused part of current plans.
15. Changes to these Terms
We may update these Terms. We will post the new version here with a new effective date and, for important changes, a notice on the website. Continuing to use the Service after a change means you accept it.
16. Law and disputes
These Terms are governed by the laws of the State of [State] and of the United States, without regard to conflict-of-law rules. Before filing a claim, please write to us so we can try to settle it informally within 30 days. Any claim that is not settled will be heard in the state or federal courts located in [County], [State], and you and we consent to their jurisdiction. Either of us may bring a qualifying claim in small claims court. If you live in a country that gives you the right to bring claims in your local courts, that right is not affected.
17. General
These Terms, with the pages they mention, are the whole agreement between you and us about the Service. If a part of them cannot be enforced, the rest still applies. Not enforcing a part is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours as part of a sale or reorganization of the business.
